2. Eligibility
To make a booking request for flights and flight-related services on the Flight Portal, you must be at least 18 years old and act as a private consumer (not a business).
3. Your Contractual Partner
For flight services and all related flight arrangements, your contractual partner is:Airbeas Online Travel Private Limited – India, C-699, Ramphal Chowk Rd, Block C, Sector 7 Dwarka New Delhi - 110077
4. Scope of Services
4.1 Mediation of Travel Services
- Airbeas Travel IN acts as a mediator for travel and flight-related services offered on the Flight Portal (collectively referred to as "Travel Services").
- We act as a middleman between you and third-party providers like airlines, travel operators, insurance companies, hotels, car rental companies etc. (each a "Service Provider").
- You enter a direct agreement with the Service Provider for the actual Travel Services (e.g., a transportation contract or an insurance contract).
- Airbeas Travel is not a co-vendor and is not a party to the Service Provider's contract with you.
- We can act as your agent with the Service Provider(s) for payment mediation and to ensure the transaction is completed.
- A commission for our mediation services may be included in the price of the Travel Services.
- The Service Provider is solely responsible for the performance of the Travel Services.
- Airbeas Travel IN does not accept any responsibility for the Travel Services and makes no warranties about their suitability or quality.
- The Service Provider is responsible for any claims you may have regarding the Travel Services.
- When ordering Travel Services, you can submit special requests (e.g., special meals, disability facilities, child seats). We will forward these requests to the Service Provider, but we cannot guarantee they will be fulfilled.
4.2 Our Own Services
- The Flight Portal also provides additional services (not related to Travel Services) for which Airbeas Travel IN is responsible.
- You will have a direct contractual relationship with Airbeas Travel IN for such services.
- We will clearly indicate if we are providing our own services or facilitating third-party services.
- Our service portfolio may change over time. Below policies explain some of our own services.
- A complete explanation of additional services, costs, and supplemental terms and conditions will be provided during the booking process.
4.3 Applicable Contractual Conditions
- These terms and conditions apply to both the mediation of travel services (Section 4.1) and our own services (Section 4.2).
- The agreement between you and the Service Provider is governed by the Service Provider's general terms and conditions (e.g., carriage conditions, transfer conditions, insurance conditions).
- The Service Provider's terms and conditions will be communicated to you during the booking process. You should read them carefully as they may include rules on responsibility, cancellation, changes to bookings, refunds (if available), and other restrictions.
5. Booking Process and Contact Information
- During the booking process, you will have tools to identify and correct errors in your booking request before submitting it. Please double-check all information for accuracy before submitting.
- Please be advised that any subsequent requests for modifications may incur additional fees.
- Airbeas Travel may contact you regarding changes to your purchased Travel Services. Please ensure your contact information, such as phone number and email address, is accurate.
- You are also responsible for ensuring you can receive messages from Airbeas Travel IN. Airbeas Travel is not liable if you do not receive a message due to circumstances beyond their reasonable control, such as:
- You provided an incorrect email address.
- Your email settings prevent Airbeas Travel's email from reaching you.
- Airbeas Travel's email is treated as spam by your email settings.
6. Mediation of Flights
6.1 Conclusion of Contract and Price Changes
- 6.1.1 Booking Request Confirmation: The receipt of your booking request will be confirmed upon submission. This signifies the commencement of the mediation agreement between you and Airbeas Travel IN.
- 6.1.2 Ticket Confirmation: You will receive a confirmation email with a ticket number once your requested tickets have been granted. This confirms a legally binding agreement between you and the relevant airline(s).
- 6.1.3 Price Changes Before Contract: If the airline makes changes (e.g., price changes, seat availability) after a booking request is made but before the contract with the airline becomes binding (as per 6.1.2), your payment will be fully refunded, and the contract will not enter into force.
6.2 Information on Booking and Transport Conditions
- 6.2.1 Airbeas Travel's Role: Airbeas Travel solely acts as a mediator for flights listed on the Flight Portal. We are not contractually responsible for the performance or non-performance of your flight as the agreement for flight performance is between you and the airline.
- 6.2.2 Airline Terms and Conditions: The terms and conditions of the specific airlines will be made available to you before you conclude any of your bookings.
- 6.2.3 Booking System Access: Airbeas Travel does not have guaranteed access to the airline's booking system while mediating airline-provided Travel Services. In instances of this nature, Airbeas Travel may engage in negotiations with the airline to establish a contract on your behalf. For questions about reservations, changes, or cancellations, please contact the relevant low-cost airline directly. However, if you purchased our Flexible Ticket service (see Section 11), any reservation change requests must be made through our customer service department, as detailed in Section 11.1.4. You may receive two reservation confirmations: one from Airbeas Travel and one from the airline. If you have received two reservation confirmations, please use the booking confirmation from the low-cost airline for check-in.
- 6.2.4 General Flight Information: The following provides general information on booking and transportation conditions frequently applied by airlines. However, any deviating provisions of the relevant airline take precedence over the general information in this section. Please review the specific terms and conditions of the relevant airline before making your reservation.
A. Flight Times/Check-in:
- All flight times are based on local time zones. A "+1" on the timetable indicates arrivals the next day.
- The mentioned flight times are estimates and may change due to flight control constraints, weather, or airline operational limits. Please verify current flight times well in advance.
- Adhere to the airline's check-in requirements. Late check-in may result in denied boarding.
- Some airlines may charge a fee for check-in at the airport; check-in on the airline's website is recommended.
B. Combination of Individual Tickets:
- If a combination of two separate one-way tickets is booked instead of a round-trip ticket, it is explicitly marked as such during the booking process.
- In case of cancellation, change, or disruption of air traffic, these tickets are treated separately.
- The rules of each airline will apply.
- Flight tickets issued under different booking numbers are invariably regarded as distinct and separate journeys.
C. Flight Tickets with Several Segments/Order of Use
- Your roundtrip or one-way ticket may consist of multiple flight segments.
- Most airlines require these segments to be used in a specific order.
- Failure to comply may result in the airline refusing to transport you on subsequent segments (e.g., not using one leg of a journey may result in the loss of the remaining ticket).
- For roundtrip tickets, a no-show on the departure flight may cause the airline to cancel your return flight.
D. Pregnancy
- Some airlines may restrict travel for pregnant women beyond a certain gestational week (typically 28 weeks).
- If you are pregnant, consult with your doctor and the airline regarding travel restrictions.
E. Infant and Child Tickets
- Contact the airline for information on flying with a child who does not require a separate seat.
- Children over two years old usually require a separate seat.
- Children aged 0-2 are considered infants and do not require a seat.
- If the child turns two during the journey, a child ticket must be purchased for the remaining travel.
- Infant tickets cannot be purchased before the child's birth as the name and birthdate must match the passport.
- We are not responsible for any expenses incurred due to booking the incorrect ticket type.
F. Unaccompanied Minors
- We do not assist unaccompanied minors in purchasing tickets.
- In accordance with established guidelines, minors under the age of eighteen are required to be accompanied by a responsible adult when traveling. This mandate ensures the safety and well-being of young individuals, facilitating their ability to navigate potential challenges that may arise during travel. It is imperative that caregivers remain vigilant and proactive in supervising these minors to ensure compliance with all travel regulations and to promote a secure environment throughout the journey.
- Some countries and airlines may not allow children under 18 to travel without a legal guardian.
- Some airlines may require children under 18 to travel with a birth certificate.
G. Lost/Damaged Luggage
- As an intermediary, we are not responsible for lost or damaged luggage.
- Report any issues immediately to the airline's agent at the airport.
H. Transit and Overnight Accommodation
- The cost of ground transportation and/or overnight accommodation is generally not included in the flight ticket price.
- You are responsible for researching and arranging ground transportation.
I. Connection Times Between Flights
- Connection times for standard tickets purchased through the Flight Portal have been approved by the airlines.
- Airlines are obligated to assist you in reaching your final destination if a flight segment is delayed and causes a missed connection.
- When booking separate tickets, airlines are not responsible for missed connections due to delays.
- Ensure the connecting time provided by the airlines and airports is sufficient.
- Any additional costs incurred due to missed connections are not refundable.
J. Double Booking
- A double booking transpires when two or more reservations are made with the same airline under an identical passenger name.
- The airline may cancel your travel if a double booking is detected.
- This can occur even if the reservations were made through different travel agents.
- We are not liable for flight cancellations or rejected airline refunds in cases of suspected double bookings.
K. Hazardous Materials
- Most items are prohibited on aircraft, including paints, lighter fluid, fireworks, tear gas, oxygen bottles, and radiopharmaceuticals.
- Small quantities (up to 70 ounces total) of medicinal and toiletry items in your luggage, and some smoking materials carried on your person, are generally permitted.
6.3. Timetable Changes and Cancellation by Airlines
- 6.3.1 Airline Authority: Airlines may change or cancel your reservations at any time. We will inform you of any changes as soon as the airline notifies us.
- 6.3.2 Flight Time Changes: Flight times may vary between the date of your booking and the actual flight date. We recommend contacting the airline at least 72 hours before the scheduled departure to confirm flight times. We have no control over airline schedule changes and are not liable for any resulting fees.
6.4 Changes and Cancellations Requested by Customers
- 6.4.1 Airline Control: The airline determines the terms for modifying tickets (e.g., name changes, destination changes, date changes) and issuing refunds. As a mediator, we have no control over these terms.
- 6.4.2 Our Assistance (Optional Service): We offer to assist you with changes or cancellations, subject to the airline's terms and conditions. You can check our fees for this service. To cancel your Travel Services, you must notify Airbeas Travel in writing by phone or by email to care@airbeastravel.co.in prior to the deadline. Your cancellation will only be effective once you receive confirmation from Airbeas Travel.
- 6.4.3 Change Request Deadline: For us to assist with changes, requests must be received at least 24 hours before the start of travel (by phone). If you have purchased our Flexible Ticket service (see Section 10), refer to its specific terms.
- 6.4.5 Cancellation fees may include: A fixed fee charged by Airbeas Travel for processing your cancellation, cancellation fees charged by the Service Provider, such as airline cancellation fees or hotel cancellation penalties, and any non-refundable portions of your Travel Services, such as taxes and fees. The specific cancellation fees for your Travel Services will be displayed during the booking process and will be included in your booking confirmation email.
Direct Airline Contact: For urgent changes, it is recommended to contact the airline directly.
6.5 Non-Appearance or Non-Attendance cancellations
Airbeas Travel reserves the right to cancel your Travel Services at any time before your departure date in the following circumstances:
- If you fail to make full payment for your Travel Services by the due date.
- If you fail to provide all required travel documents, such as a passport or visa.
- If you engage in disruptive or dangerous behavior that could jeopardize the safety of yourself or others.
- If the Service Provider cancels the Travel Service due to circumstances beyond Airbeas Travel's control (e.g., airline schedule changes, force majeure events).
6.5.1. In the event that Airbeas Travel cancels your Travel Services, you will be offered a full refund of any payments made to Airbeas Travel for the cancelled Travel Services. However, you may not be entitled to a refund of any cancellation fees charged by the Service Provider.
6.5.2. Airbeas Travel will use reasonable efforts to notify you of a cancellation as soon as possible.
6.6 No Show
6.6.1. If you fail to show up for your Travel Services without cancelling your booking in advance, you will be considered a "no show" and will not be entitled to any refund.
6.7 Changes to Your Booking
6.7.1. You may be able to make changes to your Travel Services, such as changing your flight dates or accommodation. However, change fees may apply as set out by the Service Provider.
6.7.2. To request a change to your Travel Services, you must contact Airbeas Travel in writing by email to care@airbeastravel.in.
6.7.3. Airbeas Travel will use reasonable efforts to accommodate your request, but cannot guarantee that changes will be possible.
7. Multiple-Service Bookings
- Separate Contracts: When booking multiple services through the Flight Portal, you enter into separate contracts with each service provider. We act as a mediator between you and each provider.
8. Passport, Visa, and Health Requirements
- Your Responsibility: You are responsible for verifying passport, visa, and health requirements with the relevant authorities (e.g., embassy, consulate) well in advance of your trip.
- Visa Application: Obtaining a visa can take time, so apply well in advance.
- Destination Requirements: You are responsible for researching entry requirements, immunizations, and other procedures for your destination.
- Disclaimer: We are not liable for any issues arising from your failure to comply with these requirements.
9. Our Own Services
9.1 Flexible Tickets
10. Payment
10.1 Making a Payment
- Airbeas Travel IN, its affiliates, payment processors, the Flight Portal provider, or the Service Provider may handle payment for your Travel Services.
- When we share your payment information with our payment processor, it is encrypted and stored securely.
- Depending on the specifics of your booking and any additional services you may select, your payment might be divided into two separate transactions: one processed by Airbeas Travel and another by the Service Provider. It is important to note that the total price displayed on the website will not be exceeded.
- The Service Provider's prices and fees may not always be in the same currency as those shown on the Airbeas Travel website. The website shows an approximation in its default currency. This means the amount charged by the Service Provider when you book using a credit card may vary slightly due to currency exchange rates. You will be informed during booking if this applies.
- You must have enough funds available for Airbeas Travel to process your payment.
- If there is a problem processing your payment, Airbeas Travel and its payment processor will try again. If this fails, Airbeas Travel will contact you for new payment instructions. If you don't pay after receiving instructions, your unpaid payment may be sent to a collection agency.
10.2 Payment Fraud
Airbeas Travel reserves the right to refuse payment if it suspects fraud. Law enforcement may be involved to investigate suspected payment crimes. Any payment fraud will be reported to the authorities.
10.3 Refunds
- Refunds are handled according to the Service Provider's terms and conditions.
- If you are eligible for a refund, it will be processed using the same payment method you used to book.
- Airfare is made up of many components, and not all are refundable. Even if you qualify for a refund under the Service Provider's policy, the refunded amount may be less than what you paid.
- All refunds are issued by the Service Provider. As a mediator, Airbeas Travel has no control over the Service Provider's processing times.
- Airbeas Travel will only facilitate a payment refund if it has already received a refund from the Service Provider.
- The total price of your booking includes the price of the Travel Service(s), any add-ons, and Airbeas Travel's service fees. Service fees are non-refundable because they cover Airbeas Travel's mediation services, which are considered complete once your booking is confirmed.
11. Claims
11.1 Claims about Travel Services
Any issues, comments, or claims about the actual performance of the Travel Services must be directed to the Service Provider you have a contract with for that Travel Service.
11.2 Claims about Airbeas Travel's Services
Claims about Airbeas Travel's services must be made in writing within two months of your trip's end date. You can submit claims to: support@airbeastravel.co.in
12. Liability
12.1 Airbeas Travel CA as a Mediator
- You agree that Airbeas Travel acts as a mediator between you and the Service Provider.
- Airbeas Travel is not liable for any Travel Services you book with a Service Provider.
- Airbeas Travel is not liable for any errors in information on the Flight Portal provided by the Service Provider.
12.2 Service Provider Insolvency
- If a Service Provider cannot deliver a Travel Service (e.g. due to bankruptcy ), Airbeas Travel can only act as a mediator and issue a refund if it has already received the refund from the Service Provider.
12.3 Airbeas Travel's Liability for its own Services
- Airbeas Travel is liable for damages related to its own services, subject to these terms and conditions and applicable laws.
- Airbeas Travel's liability is limited to direct damages you actually experience, pay, or incur due to a breach of its obligations for its services, up to the cost of your booking (for one event or a series of connected events).
- Airbeas Travel is not liable for any legal responsibility due to shortcomings in reservations, confirmations, or service execution caused by unusual events beyond Airbeas Travel's control (force majeure).
12.4 Limitation of Liability
- The limitation of liability also applies to breaches of duty by people for whom Airbeas Travel is legally responsible.
13. Data Protection
- Airbeas Travel is committed to protecting your personal information. Our Privacy Policy explains how we collect, use, and manage your personal information.
14. Cancellation and Refund Policies
- Airline refunds/future credits are subject to each airline's fare restrictions, policies, and procedures.
- Service fees are charged per passenger, per ticket for modifications, refunds, cancellations, and future credits.
- Airbeas Travel's transaction service fees (booking fees) and all post-ticketing service fees are non-refundable and subject to change without notice.
- Government taxes and fees are subject to change. Only the final total price stated or quoted by Airbeas Travel's agent will be charged.
- Most Airbeas Travel flight tickets are non-refundable.
- Refunds are only possible if:
- The Travel Supplier's fare rules allow cancellations and refunds for your flight bookings.
- Airbeas Travel has accepted your refund request.
- ○ou are not a "no-show" for your flight.
- Airbeas Travel is able to obtain waivers from suppliers to fulfill the cancellation and refund request.
15. Taxes and Fees
- Taxes and fees vary depending on the airport you fly into or out of.
- Travelers may incur personal charges due to unsatisfactory passenger transportation or related auxiliary service delivery.
- Any adjustment or refund is subject to the airline's terms and conditions and fare rules. There may be additional airline fees. As a mediator, Airbeas Travel has no control over these fees.
- If the intended adjustment results in a more expensive ticket or you lose access to a special rate, you are responsible for these charges.
